By visiting and using this Website, you are agreeing to be bound by the terms and conditions of this Policy, as well as our Terms of Service, all disclaimers, and other terms and conditions that appear elsewhere on our Website. Your use of this Website (whether as a waitlist subscriber, sample recipient, visitor, or another individual whose information we collect pursuant to this Policy) constitutes your affirmative consent to our collection, use, and disclosure of information, including Personal Information (as defined below), as detailed in this Policy.
2. Children Under the Age of 16
Our Website is not intended for children under 16 years of age without prior written consent from that child's parent or legal guardian. No one under age 16 may provide any Personal Information to or on the Website. We do not knowingly collect Personal Information from children under 16. If you are under 16, do not use or provide any information on this Website, including your name, address, telephone number, email address, or any username. If we learn we have collected or received Personal Information from a child under 16 without appropriate consent, we will delete that information. 3. Information We Collect About You and How We Collect It
We collect several types of information from and about users of our Website, including information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device ("Personal Information"). Personal Information does not include: (a) publicly available information from government records; (b) deidentified or aggregate consumer information; or (c) information excluded from the scope of the California Consumer Privacy Act ("CCPA").
The CCPA identifies eleven (11) categories of Personal Information and requires online businesses to disclose which categories have been collected from consumers within the preceding twelve (12) months. Emtru is a pre-launch brand that currently collects only a limited set of information — primarily to manage our waitlist, ship free samples, and send promotional communications. Our current collection is as follows:

We collect this information:
Directly from you. When you join our waitlist, we typically collect your email address. When you request a free sample, we additionally collect your name, shipping address, and phone number (the phone number is used only in connection with fulfilling and shipping your sample — for example, for carrier delivery notifications).
Automatically, as you navigate the Website, through cookies and similar technologies (see Cookies and Third-Party Tracking).
From third parties and service providers, namely Shopify (our e-commerce and hosting platform) and Klaviyo (our email marketing platform).
A. Information You Provide to Us
This includes information you submit through waitlist and sample-request forms, correspondence you send us (including customer support emails), and any responses to surveys we may run.
B. Information We Collect Through Automatic Data Collection Technologies
As you navigate the Website, we may automatically collect details of your visit, including traffic data, IP address, browser type, operating system, and pages viewed. This helps us understand how visitors use the Site, keep it secure, and improve it over time.
C. How We Respond to "Do Not Track" Signals
Browsers do not consistently communicate "Do Not Track" signals in a standardized way, so we do not currently respond to them differently. We do not sell Personal Information or engage in cross-context behavioral advertising that would otherwise be affected by such signals.
D. Third-Party Use of Cookies and Tracking Technologies
Our Website is powered by Shopify, and our email communications are powered by Klaviyo. These providers may place cookies or use tracking pixels (for example, to track email opens or clicks) as described in Cookies and Third-Party Tracking below. We do not currently use Google Analytics, Meta/Facebook Pixel, TikTok Pixel, or any interest-based advertising networks. If this changes, we will update this Policy.
4. How We Use Your Information
We use information we collect for the following purposes:
To manage waitlist sign-ups and respond to early-access requests.
To fulfill and ship free samples or promotional items, including calculating any applicable shipping and handling fees.
To deliver discount codes and promotional offers you've opted in to receive.
To send you newsletters, product updates, and marketing communications via email (with your consent, where required by law).
To respond to customer inquiries and provide support.
To maintain the security and integrity of our Website and prevent fraud or abuse of promotions.
For testing, research, and product development, including improving the Website.
To comply with applicable law, legal process, or governmental requests.
To evaluate or conduct a merger, sale, or transfer of some or all of our assets.
For any other purpose disclosed to you at the time of collection, or with your consent.
We currently do not display third-party advertisements on the Website. We will not collect additional categories of Personal Information or use collected information for materially different purposes without providing notice.
5. Email and Text Messages Opt-Out
We currently send marketing communications by email only (we do not send SMS/text marketing at this time). If you supply your email address, you may receive periodic marketing emails from us regarding waitlist updates, product launches, discount codes, or promotions. You may opt out at any time by clicking "unsubscribe" in any email, or by emailing hello@emtrufoods.com with "Opt-Out" in the subject line. Certain transactional communications (e.g., regarding a sample shipment) may not be affected by a marketing opt-out. Opt-out requests may take several days to process. If we introduce SMS/text messaging in the future, we will update this Policy and obtain any consent required by law.
6. Disclosure of Your Information
We may disclose aggregated or de-identified information without restriction. We may disclose Personal Information for the following business purposes:
To service providers, such as Shopify (hosting, e-commerce infrastructure) and Klaviyo (email marketing), who are contractually restricted from using it for their own independent purposes.
To shipping carriers, to fulfill free sample or promotional item deliveries.
To a buyer or successor, in the event of a merger, acquisition, or sale of some or all of our assets.
To comply with law, legal process, or government requests, or to protect our rights, property, or safety.
With your consent, or to fulfill the purpose for which you provided the information.
We do not sell or "share" (as defined under the CCPA) Personal Information, and we have not done so in the preceding twelve (12) months.
7. Your Rights and Choices for California Residents
Regardless of where Emtru is based, if you are a California resident, the CCPA may give you the following rights with respect to your Personal Information:
A. Right to Know and Data Portability
You may request that we disclose: (i) the categories of Personal Information we collected about you; (ii) the sources of that information; (iii) our purpose for collecting it; (iv) the categories of third parties with whom we share it; and (v) the specific pieces of Personal Information we hold about you.
B. Right to Delete
You may request that we delete Personal Information we've collected from you, subject to certain legal exceptions (for example, where retention is necessary to complete a transaction, prevent fraud, or comply with a legal obligation).
C. Right to Correct
You may request that we correct inaccurate Personal Information we maintain about you.

We will confirm receipt of your request and will need to verify your identity (e.g., via your name and email address on file) before completing it. We do not charge a fee to process a verifiable request unless it is excessive or unfounded, in which case we'll explain why before proceeding.
E. Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights — including by denying you goods or services, or charging different prices, as a result of your request.
8. State Privacy Rights Outside of California
Colorado, Connecticut, Virginia, and Utah each provide their residents with rights to confirm whether we process their Personal Information, access and delete certain Personal Information, request data portability, and opt out of processing for targeted advertising or sales (we do not currently engage in either). Colorado, Connecticut, and Virginia also provide rights to correct inaccuracies and opt out of certain automated profiling.
Nevada residents have a limited right to opt out of certain sales of personal information; we do not currently sell personal information triggering this right.

We implement commercially reasonable administrative, technical, and physical measures designed to protect your Personal Information from accidental loss and unauthorized access, use, alteration, or disclosure. However, no transmission of data over the internet is completely secure, and we cannot guarantee absolute security. Any transmission of Personal Information to us is at your own risk.
11. Transfers of Information
Emtru is based in the United States. Information you provide will be stored and processed by our service providers in the United States. If you access the Website from outside the United States, your information may be transferred to, and processed in, the United States, whose privacy laws may differ from those of your home jurisdiction.
12. Geographical Restrictions
Our Website is intended for use only by persons located in the United States and its territories. We make no claims that the Website or its content is appropriate or available for use outside the United States. If you access the Website from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
